Cheese is a mobile application that allows users to:
• Capture photos and videos
• Organize content in a calendar view
• Share content with friends and family
• Access premium features through subscription

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice. We may also impose limits on certain features or restrict access to parts of the Service without notice or liability.

You may be required to create an account to access certain features of our Service. When creating an account, you must provide accurate, complete, and current information. You are responsible for safeguarding your account credentials and for all activities that occur under your account.

You agree to immediately notify us of any unauthorized use of your account or any other breach of security. We will not be liable for any losses caused by any unauthorized use of your account.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Upload, post, or transmit any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or invasive of another's privacy
• Impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity
• Upload, post, or transmit any content that infringes any patent, trademark, trade secret, copyright, or other proprietary rights
• Upload, post, or transmit any unsolicited or unauthorized advertising, promotional materials, spam, or junk mail
• Interfere with or disrupt the Service or servers or networks connected to the Service
• Use any robot, spider, or other automatic device to access the Service
• Attempt to gain unauthorized access to any portion of the Service
• Use the Service to violate any applicable laws or regulations

You retain ownership of any content you create, upload, or share through the Service ("User Content"). By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and distribute your User Content solely for the purpose of providing and improving the Service.

You represent and warrant that you own or have the necessary rights to all User Content and that your User Content does not violate any third-party rights or applicable laws.

We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable in our sole discretion.

Premium Subscription:
Cheese Pro Monthly Subscription: $2.99 per month (or equivalent in local currency)

Payment and Billing:
• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase

Refunds:
All purchases are final. No refunds will be provided for any subscription fees, except as required by applicable law or at our sole discretion.

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information when you use our Service. By using our Service, you agree to the collection and use of information in accordance with our Privacy Policy.

Face Data: The App does not collect, analyze, or process biometric face data for identification purposes. Any faces appearing in photos or videos are incidental content created by you. We do not perform facial recognition, biometric analysis, or identification on your content.

The Service and its original content, features, and functionality are and will remain the exclusive property of Cheese and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

Nothing in these Terms constitutes a transfer of any intellectual property rights from us to you. All rights not expressly granted are reserved.

We respect the intellectual property rights of others. If you believe that any content on our Service infringes your copyright, please contact us at hello@cheeseday.co with the following information:
• A description of the copyrighted work you claim has been infringed
• The location of the allegedly infringing content
• Your contact information
• A statement that you have a good faith belief that the use is not authorized
• A statement that the information is accurate and you are authorized to act on behalf of the copyright owner

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever including, without limitation, a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the Service and cancel any active subscriptions through the App Store.

Upon termination, your right to use the Service will cease immediately. All provisions of the Terms which by their nature should survive termination shall survive termination.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE MAKE NO WARRANTY THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, BE AVAILABLE ON AN UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE BASIS, OR BE ACCURATE, RELIABLE, FREE OF VIRUSES OR OTHER HARMFUL CODE, COMPLETE, LEGAL, OR SAFE.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CHEESE, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF OR ANY INABILITY TO USE ANY PORTION OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY.

You agree to defend, indemnify, and hold harmless Cheese and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of:
• Your use and access of the Service
• Your violation of any term of these Terms
• Your violation of any third party right, including without limitation any copyright, property, or privacy right
• Any claim that your User Content caused damage to a third party

These Terms shall be interpreted and governed by the laws of the jurisdiction in which our company is incorporated, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will be conducted in English and the arbitrator's decision will be final and binding.

Notwithstanding the foregoing, we may seek injunctive relief in any court of competent jurisdiction to protect our intellectual property rights.

We shall not be liable for any failure or delay in performance under these Terms which is due to earthquake, fire, flood, act of God, act of war, terrorism, epidemic, pandemic, government action, or other causes which are beyond our reasonable control.

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
